On February 20, 2026, the US Supreme Court ruled tariffs under the IEEPA unlawful (Learning Resources v. Trump). On March 4, 2026, the CIT ordered CBP to return tariffs to all importers (universal refund order), including unliquidated and non-finally liquidated entries. Approximately $166–175 billion in tariffs have been collected. CBP is building a CAPE system in ACE for ACH refunds; the wait time is 45+ days, and delays and appeals are possible.

IEEPA tariffs imposed by EO 2025: fentanyl on China/Mexico/Canada, reciprocal on many countries were declared illegal by the Supreme Court on February 20, 2026. On March 4, 2026, the CIT issued a universal refund order: refunds to all importers for unliquidated and non-final liquidated entries. CBP is developing CAPE in ACE for e-filing, automated processing, and ACH refunds (updates March–April 2026).
